Sqord is Committed to Childrens’ Privacy

Purpose. The purpose of this Privacy Policy is to describe how Sqord, Inc. (“Company”) collects, uses and shares information about users through our U.S. online interfaces (e.g., websites and mobile applications) owned and controlled by us, including (collectively referred to herein as the “Site”). Please read this notice carefully to understand what we do. Third Party Sites. This Privacy Policy applies only to information we collect at and through the Site. Our Site may also contain links to third party sites that are not owned or controlled by Company. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage users to be aware when they leave our Site and to read the privacy policies of each and every website that collects personal information.

Terms of Use. Please note that use of our Site is also subject to our Terms of Use. COPPA Compliance. We ensure that our Site and our information collection policies comply with the Children’s Online Privacy Protection Act (“COPPA”), a U.S. law designed to protect the online privacy of children under the age of 13.

Information Individual Users Provide To Us.

When users, including children under 13, register on or purchase an individual paid membership and/or individual Sqord product, we may collect personally identifiable information (“PII”) from the registrant (or via the registrant’s parent) in that registration or transaction.

The types of PII that may be collected for registration and to use the Sqord service include the registrant’s full name, email address, mailing address, credit card or debit card billing information, height, weight, birth date and gender. If the registrant is under 13 years old, then a parent of the child may be invited to provide this information, as explained in more detail below. We use the collected PII to provide the Sqord service, operate the Site, process payments to Sqord, and for fraud prevention purposes.

Obtaining Sqord through a School or Youth Organization. In some cases a Sqord membership is provided to users under 13 years of age by their school or youth organization. Since no PII is captured from registrants under 13 when there is not an individual membership being purchased, the Site does not require users under 13 to obtain parental consent.

Collecting Parent Email Addresses During the Registration process, and occasionally during the normal usage of the site, players under 13 are prompted to optionally provide a parent’s valid email address in order to send their parent a voluntary notice that they are engaging on the Sqord platform, and to invite them into the Sqord Parent Portal.

When optionally provided by the child, we use the parent’s email address only to send the parent a message of voluntary notification, and to invite them to the Sqord Parent Portal. In those cases, Sqord does not store or keep any permanent copy of the parent’s email address.

From within the Parent Portal the parent may opt to permit Sqord to use that email to notify the parent about our privacy practices, and to send the parent communications either about the parent’s and child’s Sqord accounts or about features of our website, and for such other purposes as described in this Privacy Policy. This email address is then correlated with the account user name. We may then also use this email address to send promotional messages regarding Company (with the permission of the user or, for a user under 13, the parent of the user) or to address any customer service queries, such as password retrieval. The Parent’s online contact information will not be used or disclosed to third parties for any other purpose.

The Site does not condition a child’s participation in an online activity on the child providing more personal information than is reasonably necessary for Sqord to provide that activity. To this end, the child can register for and use the Site anonymously, using only an auto-generated username, account password, gender, and date of birth, and a wearable Sqord pod (if purchased by a grown-up).

Additional Information and Remedies for Parents. The Parent may refuse to permit the child’s participation on Sqord by refusing their children permission to wear the Sqord Pod or to sync it. Additionally the parent can refuse permission by not activating your child’s account or not registering your child, when the parent is the party setting up the account.

If a Parent has any questions or concerns with their child’s participation on Sqord, they may contact us at for answers or remedies, or, by request, the complete deletion of your child’s account. See below for information on closing an account.

Player Activities and Interactions. Sqord activities include viewing content, choosing a PowerMe graphic character, and providing content to the Site, including by uploading activity data to the Site, tagging that activity (basketball, P.E., walking to school, etc.), joining a Sqord team, and using our pre-moderated social messaging functions.

We enable users to communicate online with other users anonymously. Social messaging functions include a “Thought Bubble” (a message that is communicated by a player to everyone on the team to express his or her current thoughts, selected from a fixed menu), a “Squawk” (a communication between two users, selected from a fixed menu), a “High Five” (positive communications from one user to another in congratulations or support of an achievement), or notification of a win or a loss.

Thought Bubbles and Squawks are selected from a fixed menu so users cannot communicate personal information through these social messaging functions, and parents have the ability to block or report questionable user names.

Sqord does not otherwise collect, use, or disclosure personal information collected from the child.

Information Schools provide to us.

In some cases a Sqord membership is provided to users under 13 years of age by their school or youth organization, which is overseen by an adult administrator who is on staff at that school or youth organization.

The Site requires users to input a valid join code, provided by a Sqord Administrator at their school or youth organization, in order to participate in the Sqord activities through that organization. The organization may also require direct consent from parents via permission slips or other instruments that are not provided or related to Sqord, Inc.

Administrators may provide additional information on their players in their own notes, such as type of activities performed by a group, allocation of a player to a named group (such as a classroom teacher’s name, or a sports team name). In some cases, Administrators may also choose to fill out the above required registration fields on behalf of their players.

Online Surveys. In order to improve the user experience on our website, we may employ online surveys for visitors to volunteer anonymous demographic information about themselves and provide us feedback about why they visit the website and what we can do to make it better.

Whatever the activity may be, we will only collect information to the extent deemed reasonably necessary to fulfill your requests.

Testimonials. From time to time, we display personal testimonials of satisfied customers on our site in addition to other endorsements. With your consent or the consent of a parent or legal guardian we may post your testimonial along with your name or part of your name. Information We Collect Automatically.

We may collect certain information automatically from Site visitors to support the internal operations of the Site, such as

  • IP address
  • Browser type (e.g., Firefox, Internet Explorer)
  • Computer or mobile device type
  • Unique device identifiers
  • Operating system version (e.g., Windows or Mac OS)
  • The URL from where the user navigated to our Site
  • The pages on our Site that the user views and the frequency with which the user views them
  • Time and date of using our Site
  • The name of the user’s Internet service provider (ISP)
  • Location / Geolocation of where users are syncing points, which Sqord uses to study relative physical activity by local geography, cities, counties, and states to improve the service and our understanding of our customers.

Cookies. When a user visits our Site we send one or more “cookies” to the user’s computer or other device. A cookie is a small file containing a string of characters that is sent to your computer when you visit a website. When you visit the website again, the cookie allows that site to recognize your browser. Cookies may store unique identifiers, user preferences and other information. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some Site features or services may not function properly without cookies. We use cookies to improve the quality of our service, including for storing user preferences, tracking user trends and providing relevant Sqord promotional material.

Pixel Tags. We may use “pixel tags,” also known as “web beacons,” which are small graphic files that allow us to monitor the use of our Site. A pixel tag is a type of technology placed on a website or within the body of an email for the purpose of tracking activity on websites, or when emails are opened or accessed, and is often used in combination with cookies. A pixel tag can collect information such as the IP (Internet Protocol) address of the computer that downloaded the page on which the tag appears; the URL of the page on which the pixel tag appears; the time the page containing the pixel tag was viewed; the type of browser that fetched the pixel tag; and the identification number of any cookie on the computer previously placed by that server.

3rd Party Tracking. The use of cookies by our tracking utility company, service providers is not covered by our privacy policy. We do not have access or control over these cookies.

Social Media Widgets. Our Web site includes Social Media Features, such as the Facebook Like button and Widgets, such as the Share this button or interactive mini-programs that run on our site. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy policy of the company providing it. These features are made available only in those areas of the service or the Site intended for and directed to grown-ups (parents, teachers, etc.).


To Provide Products, Services, and Information. In addition to the purposes described in Section 2, we collect information from users and parents so that we can provide products and services that are purchased using the Site, and provide information that users and parents request from us. We use personal information to contact users and parents about orders, process credit card transactions, and ship products. We may send users and parents information about our products and services, and new offerings. We may use demographic information (i.e., gender, birth date and country of residence) and information in the aggregate to better understand our customers, and improve our products and services. We may also use email addresses and user names to enable parents to review PII that their children have submitted to the Sqord Site.

To Provide Support for Internal Operations. We may use third parties to help us provide support to the internal operations of the Site (i.e, hosting our Site, sending out email updates about the Site, providing contextual advertising on the Site, removing repetitive information from our user lists, processing orders and payments, and fulfilling and delivering products and services that are purchased from us). These service providers will have access to personal information in order to provide these support services such as shipping our products or analyzing site data, but when this occurs we implement reasonable contractual and technical protections to limit their use of that information to helping us provide the service.

To Provide Non-Identifiable Information to Third Parties. We monitor users’ use of the Site and aggregate user data (which includes some personal user information like age and gender) so that the data is not in personally identifiable form. You agree that Company retains a royalty-free, irrevocable, transferable right and license in such user data, and that we may sell or otherwise make such aggregated user data available to third parties (including parties who may provide contextual advertising on the Site and researchers who incorporate the data into studies), but only so long as (1) such information transferred to third parties does not include any personally identifiable information and (2) the provision of such information otherwise complies with all applicable laws. We do not disclose any PII to third parties, other than to provide support for our internal operations.

To Facilitate User-Initiated Software and Hardware Integrations. Sqord may offer our users who are over the age of 13 opportunities to integrate their Sqord experience with other software and hardware products. In such cases, Sqord will explicitly describe what information is shared via the integration, and require them to indicate agreement. Users will be subject to the terms & conditions and the privacy policies of the integrated service, and will be prompted to review those as well.

Users may cancel the integration at any time by logging into Sqord and changing their settings on the Account page.

Legal Proceedings. We will share personal information with third party companies, organizations or individuals outside of Company if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

  • Meet any applicable law, regulation, subpoena, legal process or enforceable governmental request.
  • Enforce applicable Terms of Use, including investigation of potential violations.
  • Detect, prevent, or otherwise address fraud, security or technical issues.
  • Protect against harm to the rights, property or safety of Company, our users, customers or the public as required or permitted by law.

Transfer in the Event of Sale or Change of Control. If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business or the Site to a third party, such as by merger, acquisition, bankruptcy proceeding or otherwise, we may transfer or sell personal information to the new owner. In such a case, unless permitted otherwise by applicable law, personal information would remain subject to the promises made in the applicable privacy policy unless you agree differently.


Accessing and Updating Your Account. You can access, update, and delete certain information we have relating to your or your child’s online account by signing into the account and going to the Account or Family Portal section of our Site. If you have questions about personal information we have about you or your child or need to update or request deletion of any of your or your child’s information, you can Contact Us or email us at We will respond to all access requests within 7 days. You can opt-out of receiving marketing and promotional e-mails from Company by using your Account page, and by using the opt-out or unsubscribe feature contained in the e-mails.

Closing Your Account. You can close your online account by clicking on Contact Us and submitting such a request, or emailing us at If you close your account, we will no longer use your online account information. We may, however, retain a copy of the information for archival purposes, and to avoid identity theft or fraud.

Children’s Personal Information. Parents and legal guardians of children under 13 may log into the Sqord Family Portal, Contact Us, or email us at to review, update or delete any of their children’s personal information that we have collected and to elect for us not to collect any additional personal information from their children.


We use industry standard physical, technical and administrative security measures and safeguards to protect the confidentiality and security of your personal information. However, since the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is also your responsibility to protect the security of your login information.

Please note that any pages that collect personal information are encrypted to help secure your information including sensitive data such as your credit card numbers collected on order forms and when entering personal health information (height and weight for ex.). We encrypt the transmission of this information using secure socket layer technology (SSL) as well.


Company’s websites, including websites directed to residents in countries and jurisdictions outside of the United States, are operated and managed on servers located and operated within the United States. By using and accessing our Sites, residents and citizens of countries and jurisdictions outside of the United States agree and consent to the transfer to and processing of personal information on servers located in the United States, and that the protection of such information may be different than required under the laws of your residence or location.


We will retain your or your child’s information for as long the account is active or as needed to provide our services. If you wish to cancel your or your child’s account or request that we no longer use your child’s information to provide services, contact us at We will retain and use your child’s information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.


Our Privacy Policy may change from time to time. We will post any privacy policy changes on this page and, if the changes are material for either a parent or child, we will provide a more prominent notice of such changes (including, for certain services, email notification to the e-mail address specified in your account) prior to the change becoming effective, and if necessary, will obtain your prior consent or the prior consent of a parent or legal guardian. We will also keep prior versions of this Privacy Policy in an archive for your review.
